Regulations of the online store www.skalper.pl.

I. Definitions
The terms used in the Regulations mean:
1.1. Client – a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who has concluded or intends to conclude a Sales Agreement with the Seller, and who uses or intends to use the Service or Electronic Service.
1.2. User - a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, - who uses the website www.skalper.pl
1.3. Consumer - a natural person concluding a contract with the Seller within the Store, the subject of which is not directly related to his or her business or professional activity.
1.4. Distance contract - a contract concluded with the Customer within the framework of the distance contracting system (within the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the moment of conclusion of the contract.
1.5. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) ;
1.6. Statute – these Regulations for the provision of electronic services within the Skalper online store;
1.7 Online Store (Shop) – the website available at www.skalper.pl through which the Customer may, in particular, place Orders;
1.8. Commodity – products presented in the Online Store, which the Customer purchases via the Online Store from the Seller;
1.9. Sales agreement – a contract for the sale of Goods within the meaning of the Civil Code, concluded between the Seller and the Customer, concluded using the Store's website;
1.10. Act on special conditions of consumer sales – Act of 27 July 2002 on specific terms and conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended);
1.11. Act on the provision of services by electronic means – Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
1.12. Order – the Customer’s declaration of intent submitted by completing the Order Form, directly aiming at concluding the Sales Agreement, specifying in particular the type and quantity of the Goods;
1.13. Contact form – an interactive form available in the Store enabling Customers to contact the Seller;
1.14. Order Form - an electronic form available in the Store enabling the placement of an Order by adding Products to the Cart and specifying the terms of the Sales Agreement, including delivery and payment;
1.15. Shopping Cart – an element of the Store software in which the Products selected by the Customer for purchase are visible, and it is also possible to determine and modify the Order data;
1.16. Newsletter – Electronic service provided by the Seller via e-mail, which enables Customers to subscribe and automatically receive periodic, free information about new products and promotions by electronic means;
1.17. Working day - one day from Monday to Friday, excluding public holidays;
1.18. Personal data administrator - Seller;
II. General provisions
2.1. These Regulations define the rules for using the online store available at www.skalper.pl.
2.2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
2.3. The online store, operating at www.skalper.pl, is run by Skalper Spółka z ograniczoną odpowiedzialnością and is entered in the National Court Register under the Tax Identification Number (NIP): 7272884086, National Business Registry Number (REGON): 540183146
2.4. These Regulations specify in particular
a.) terms and conditions for making electronic reservations of products available in the online store;
b.) terms and conditions for placing Orders electronically within the online store;
c.) rules for concluding Sales Agreements using the services provided within the Online Store.
2.5. In order to use the online store, the Customer should obtain access to a computer station or terminal device with Internet access.
2.6. Customers can access these Regulations at any time via the link on the home page of the website www.skalper.pl, download it, and print it.
2.7. Information about the Goods provided on the Store's website, in particular their descriptions, technical and functional parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
III. Rules for using the Online Store
3.1. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of threat to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted online.
3.2. The Customer is obliged in particular to:
a.) not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
b.) use the Online Store in a way that does not interfere with its operation, in particular through the use of specific software or devices,
c.) not to take actions such as: sending or posting unsolicited commercial information (spam) within the Online Store,
d.) use the Online Store in a way that is not burdensome for other customers and the Seller,
e.) use any content posted on the Online Store only for personal use,
f.) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.
g.) In order to secure and minimize threats that may arise from using the Internet, the Customer should use appropriate technical security measures.
3.3 The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is the Seller.
3.4. Personal data are processed for the purposes, to the extent and based on the principles indicated in the Privacy Policy, which is continuously available on the Store's website.
3.5. The Customer consents to the collection, storage, and processing of personal data by the Seller for purposes directly related to the provision of the service or Goods ordered through the Online Store. Detailed terms and conditions for the collection, processing, and protection of personal data by the Seller are specified in the Online Store's Privacy Policy.
3.6. Using the Online Store means any action by the User that leads to the User becoming familiar with any content posted on the Online Store's website.
3.7. The Online Store has the right to organize occasional competitions and promotions, the terms and conditions of which will be published on the Online Store's website.
3.8 Product promotions organised via the Online Store cannot be combined, unless the terms and conditions of a given promotion provide otherwise.
IV. Procedure for concluding the Sales Agreement
4.1. In order to conclude a Sales Agreement via the Online Store, please visit the website www.skalper.pl, select the Product, then complete the Order Form available on the product page, taking subsequent technical steps based on the messages displayed to the Customer and the information available on the website.
4.2. The Customer selects the Goods to be ordered by adding them to the shopping cart.
4.3. When placing an Order – until the "Order" button is pressed – the Customer may modify the entered data and the Product selection. To do so, the Customer should follow the displayed messages and the information available on the website.
4.4. After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information regarding:
a.) the subject of the order,
b.) the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
c.) selected payment method,
d.) selected delivery method,
e.) delivery time.
4.5. In order to send an Order, it is necessary to accept the Regulations, provide personal data marked as mandatory and press the "Place an order" button.
4.6. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Seller, in accordance with the Regulations.
4.7. The sales contract is concluded in Polish, with the content consistent with the Regulations.
V. Delivery
5.1. Ordered Goods will be delivered via our own transport or courier. Delivery costs are PLN 13.99. Additional delivery costs will be indicated when placing the Order.
5.2. The delivery time is up to 7 business days from the day following the Customer's sending of the Order.
5.3. Customers can access these Regulations at any time via the link on the home page of www.skalper.pl, download it, and print it.
5.4 The essential provisions of the Goods Sale Agreement are recorded, secured, made available and confirmed to the Customer by sending a printout of the confirmation and the Order specification to the e-mail address provided by the Customer and by attaching a printout of the confirmation and the Order specification to the shipment containing the Goods.
VI. Prices and payment methods
6.1. The prices of the Goods are given in Polish zloty and include all components, including VAT (with the rate indicated), customs duties and all other components.
6.2. The customer has the option to pay the price:
a.) by transfer to the bank account number 56 1140 2004 0000 3202 8537 0929,
b.) payment via Przelewy24.
c.) payment by VISA and MasterCard.
VII. Right to withdraw from the contract
7.1 To the Consumer in relation to the Agreement:
a) you have the right to withdraw from the Agreement within the statutory period of 14 days from the date of receipt of the shipment to the address Łódź, ul. Wólczańska 161 lok. 2U 90-525.
b) in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline for withdrawal from the contract expires,
c) in which the subject of the provision is a non-prefabricated Product, manufactured according to the consumer’s specifications or intended to meet his individual needs.
d) there is no right of withdrawal from the contract in the case of the purchase of digital products (e.g. electronic files, codes, digital content) that are delivered via the website www.skalper.pl – if the performance began with the express consent of the Consumer before the expiry of the withdrawal period and after the Seller informed him of the loss of the right to withdraw from the contract.

8.5. The Customer may communicate with the Seller by telephone between 10 a.m. and 6 p.m.
IX. Complaints and Warranty
9.1. The Sales Agreement covers new and used Products.
9.2. The Seller is liable to the Buyer if the sold item has a physical or legal defect. The basis and scope of the Seller's liability to the Buyer in a situation where the sold item has a physical or legal defect are established by generally applicable law, including the Civil Code (in particular Articles 556-576 of the Civil Code).
9.3. The Seller is liable to the Customer under the warranty for physical defects (a physical defect consists in the non-conformity of the sold item with the contract) and for legal defects.
9.4. A complaint may be submitted, for example, in writing or electronically to the address indicated in point VIII Regulations.
9.5 The Seller will respond to the Customer's complaint promptly, but no later than 14 calendar days from the date the complaint was filed. Failure by the Seller to respond within this timeframe means that the Seller has deemed the complaint justified.
9.6. It is recommended that the Customer provide the following information in the complaint (which will be helpful to the Seller in the course of considering the complaint and may speed up the complaint process):
a) circumstances relating to the subject of the complaint - the Goods and the occurrence of any defects, e.g. the type and date of occurrence of the defect,
b) specification of the Customer’s request (request for a method of bringing the Goods into compliance with the Sales Agreement or submitting a declaration of price reduction or withdrawal from the Sales Agreement),
c) contact details of the Seller with the person submitting the complaint/Customer.
9.7. The recommendations provided are not mandatory and do not affect the effectiveness of the complaint handling process. A complaint form is attached as Appendix 2 to the Store Regulations.
X. Personal data in the Online Store.
10.1. The Seller is the controller of personal data collected via the Online Store. Personal data is processed for the purposes, within the scope, and based on the principles indicated in the Privacy Policy available on the Seller's website.
10.2. Customers' personal data collected via the Online Store are collected for the purpose of fulfilling the Sales Agreement.
10.3. The recipients of personal data of Online Store Customers may be:
a) in the case of a Customer who uses the Online Store's delivery method by post or courier, the Administrator makes the collected personal data of the Customer available to the selected carrier or intermediary carrying out the shipment on behalf of the Administrator,
b) in the case of a Customer who uses electronic payments or a payment card in the Online Store, the Administrator makes the collected personal data of the Customer available to the selected entity handling the above payments in the Online Store.
10.4. The Seller declares that it complies with all principles of protection of Customers' personal data provided for by law.
10.5. Providing personal data is voluntary. Every person whose personal data is processed by the Seller has the right to inspect its content and the right to update and correct it, request its deletion, and transfer it to another entity.
10.6. The Customer declares that he or she consents to the collection, storage and processing of personal data by the Seller for purposes directly related to the provision of the service or Goods ordered in the Online Store.
10.7. Providing personal data is voluntary, however, failure to provide the personal data required to conclude the Sales Agreement will result in the inability to conclude the agreement.
XI. Final Provisions
11.1. Agreements are concluded in Polish via the Online Store.
11.2. The Seller reserves the right to amend these Terms and Conditions for important reasons, including: changes in legal regulations, changes in payment and delivery methods – to the extent that such changes affect the implementation of the provisions of these Terms and Conditions. The Seller will notify the Customer of any changes at least 14 days in advance.
11.3. In the event of concluding agreements other than those of a continuous nature based on the Regulations (this applies, for example, to Sales Agreements), amendments to the Regulations will not in any way infringe the rights acquired by Customers who were Consumers before the date of entry into force of the amendments to the Regulations (including: amendments to the Regulations will not affect Orders placed or submitted or Sales Agreements concluded, executed or performed).
11.4. In the event that a change to the Terms and Conditions would result in the introduction of new fees or an increase in current fees, the Customer who is a Consumer may exercise the right to withdraw from the contract. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the Provision of Electronic Services; the Consumer Rights Act; and the Personal Data Protection Act.
11.5. Annexes to the Regulations constitute an integral part thereof.
11.6. The Regulations enter into force on November 25, 2024.
